General terms and conditions of business

These General Terms and Conditions (hereinafter referred to as T&Cs) regulate the use of the website www.bundc.at between the Baki Cinar sole proprietorship (hereinafter referred to as “bundc.at”), Hauptstraße 76, 2434 Pischelsdorf and the user of the website. After registration and confirmation of the T&Cs, the user has the right to use the services offered on the website. By accepting the contract, the user accepts these T&Cs and confirms the accuracy of the data provided by him.
1. Subject matter of the contract
Website – Taxi booking
1.1. Bundc.at provides the website to the user free of charge. The application enables the user to order taxis in real time or to pre-order them directly using the software provided. The user has the option of being directed to the nearest taxi vehicle. The user must be registered with an individual customer account to use the website.
1.2. The user concludes a brokerage agreement with bundc.at for the provision of the taxi service. It is noted that the transport agreement is concluded exclusively between the affiliated taxi company and the user. Claims arising from the passenger transport arranged via the website therefore only exist between the taxi company and the user.
1.3. The fare is calculated according to the applicable Vienna taxi tariff. Surcharges are calculated according to Section 5 Paragraph 2 of the Vienna taxi tariff.
1.4. Furthermore, the user has the option of ordering taxi vouchers and inquiring about the approximate prices for taxi rides.
2. Contract duration and termination
2.1. The contract for the use of the website and the services and brokerage services offered is concluded on the date of acceptance of the General Terms and Conditions by the user and is concluded for an indefinite period. The contract can be terminated by either party by telephone or in writing (email is sufficient) without giving reasons, but up to 24 hours before the start of the journey, free of charge. Any obligations established up to this point remain valid despite deletion and can be demanded from bundc.at. For cancellations within 24 hours before the start of the journey, Baki Cinar Einzelunternehmen has the right to collect 30% of the fare as a fee for the costs incurred.
2.2. Payment for the journey can be made either in cash, by credit card or by invoice.
2.3. Bundc.at shall not be liable for any third party liability.
3. Due diligence obligations
3.1 The user undertakes to provide truthful information (user name, email address, telephone number). The user must refrain from any actions that could lead to an impairment or overload of the website.
3.2. The user undertakes to take all reasonable precautions to protect the access data from unauthorized access by third parties. The user is prohibited from passing on the access data to third parties.
3.3. The customer undertakes to immediately inform bundc.at via email at kontakt@bundc.at upon becoming aware of the loss or theft or the suspicion of improper use.
4. Data protection
4.1 Personal data is all information that can be used to directly or indirectly identify a person, e.g. name, home address, email address, date of birth, occupation, bank details, etc.
4.2. In the case of registration on the website, bundc.at collects and processes the personal data provided by the customer and uses them for the purpose of processing the contract.
4.3. The customer can exercise his rights contained in the GDPR and DSG at any time. You can find out more about this in the data protection notice.
5. Liability
5.1. bundc.at assumes no liability for damages arising from or during the performance of the transport service.
5.2. When making payments by direct debit, the user is obliged to ensure that the bank account has sufficient funds. If the bank account does not have sufficient funds when bundc.at attempts to debit the account, the user must pay the costs resulting from the insufficient funds (in particular those of the returned direct debit).
5.3. bundc.at assumes no liability for the processing of cashless payments, in particular for credit card charges or payment processing via PayPal. In the event of incorrect or faulty bookings or disruptions during the payment process, the user must contact the payment service provider directly.
5.4. We cannot guarantee the uninterrupted availability of the website and the functions it contains. However, Bundc.at strives to ensure that the system is as reliable as possible.
6. Costs
5.1. bundc.at assumes no liability for damages arising from or during the performance of the transport service.

7. Supplementary provisions
7.1 These Terms and Conditions are subject exclusively to the laws of the Republic of Austria, excluding the UN Convention on Contracts for the International Sale of Goods.
7.2. The place of jurisdiction for all legal disputes arising from or in connection with these Terms and Conditions is Vienna.
7.3. All changes and additions to these Terms and Conditions must be made in writing.
7.4. Should any provision of this contract be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision.
7.5. Bundc.at reserves the right to change, improve or temporarily close the website in a manner that is reasonable for the user, or to stop offering the services provided. The user has no right to demand that the application be available at all times or without interruption. Bundc.at has no influence on the actual availability of the taxis arranged and
cannot accept any liability for this.
